Party With a Pole Rental Terms Of Service
Welcome to Party With a Pole, a service operated by Dirty Biker Design, LLC (“Party With a Pole,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, and online booking platform.
By accessing our website, submitting a booking request, purchasing a rental, or using our services, you agree to be bound by these Terms.
You must be at least eighteen (18) years of age and legally capable of entering into a binding agreement to rent equipment or purchase services from Party With a Pole.
By placing an order, you represent and warrant that you meet these requirements.
Party With a Pole provides portable dance pole rentals and related entertainment services, including delivery, setup, teardown, and any additional services selected during the booking process.
Descriptions, photographs, pricing, and availability are subject to change without notice.
Reservations are accepted on a first-come, first-served basis.
A reservation is not confirmed until:
- payment has been successfully processed;
- all required agreements have been accepted; and
- you receive a booking confirmation from Party With a Pole.
All prices are listed in U.S. Dollars.
Unless otherwise stated, pricing does not include applicable taxes or additional mileage outside our standard service area.
We reserve the right to correct pricing errors before accepting a reservation.
Certain rentals require a refundable security deposit.
The deposit may be applied toward:
- equipment damage;
- missing components;
- excessive cleaning;
- unpaid rental charges;
- late fees; or other amounts authorized under the Rental & Services Agreement.
Any remaining balance will be refunded after the equipment has been inspected.
Payment is due before delivery unless otherwise agreed in writing.
We accept payment methods made available through Shopify Checkout.
Failure of payment may result in cancellation of your reservation.
7. Cancellations and Rescheduling
Cancellation and rescheduling requests should be submitted as soon as possible.
Refund eligibility depends on the timing of the request and the circumstances surrounding the cancellation.
Party With a Pole reserves the right to establish or modify cancellation policies as necessary.
Delivery includes professional setup within our advertised service area.
Customers are responsible for providing:
- a safe installation location;
- adequate access;
- sufficient working space; and
- accurate delivery information.
We reserve the right to refuse installation if conditions are unsafe.
Customers agree to:
- supervise participants appropriately;
- use equipment only for its intended purpose;
- prevent unauthorized modifications;
- immediately report damage or unsafe conditions;
- comply with all safety instructions provided.
The Renter shall provide:
- Clean, level flooring
- Adequate working space
- Safe access to the installation area
- Weather protection if outdoors
- Sufficient ceiling clearance
Owner reserves the right to refuse installation if conditions are unsafe.
If installation cannot be completed due to unsafe conditions outside Owner's control, the rental fee is non-refundable.
10. Use of Equipment
The X-POLE X-STAGE shall be used only for its intended purpose.
The following are prohibited:
- More than one user at a time
- Rigging additional equipment
- Jumping onto the pole
- Moving the stage
- Modifying the equipment
- Any use contrary to manufacturer recommendations
The Renter agrees that anyone who appears impaired by alcohol, illegal drugs, or any substance affecting balance, judgment, or coordination shall not use the equipment.
Owner is not responsible for monitoring participants after setup.
Cleaning
Normal use is expected.
The Renter agrees to promptly clean any food, beverage, or other spills from the equipment during the rental period.
No tape, adhesives, glitter, confetti, paint, body oils, lotions, or similar materials shall be applied to the equipment.
Owner reserves the right to deduct reasonable cleaning costs from the Security Deposit if excessive cleaning is required.
Damage
The Renter accepts responsibility for damage occurring during the rental period beyond ordinary wear and tear.
Damage includes, but is not limited to:
- Bent components
- Scratches beyond normal wear
- Missing hardware
- Missing accessories
- Structural damage
- Water damage
- Fire damage
- Smoke damage
- Theft
- Vandalism
Owner shall document damage with photographs and provide an estimate for repair or replacement.
11. Security Deposit
The Renter authorizes Owner to retain all or part of the $300 Security Deposit to cover:
- Equipment damage
- Missing components
- Excessive cleaning
- Late pickup fees
- Additional mileage charges
- Unpaid rental charges
- Other amounts due under this Agreement
If damages exceed the Security Deposit, the Renter agrees to pay the remaining balance within fourteen (14) days after receiving written notice and supporting documentation.
12. Late Return
Equipment must be available for pickup at the agreed time.
If pickup is delayed due to the Renter's actions or inaccessibility of the equipment, additional charges may apply.
13. Photographic Documentation
Owner may photograph or video record the equipment before delivery and after pickup to document its condition.
These images may be used solely for documentation of the rental and any claims relating to damage or excessive cleaning.
Every individual intending to use rented equipment must complete any required liability waiver before participating.
The renter is responsible for helping ensure compliance by all participants.
All content appearing on this website, including logos, graphics, photographs, text, videos, branding, and designs, is the property of Dirty Biker Design, LLC or its licensors and is protected by applicable intellectual property laws.
No content may be copied, reproduced, or used without prior written permission.
You agree not to:
- interfere with website operation;
- attempt unauthorized access;
- upload malicious software;
- misuse our services;

submit fraudulent reservations.
Equipment rentals and entertainment services involve inherent risks.
Party With a Pole makes no guarantee regarding the suitability of equipment for any specific activity beyond its intended purpose.
Customers and participants assume responsibility for their own use.
To the fullest extent permitted by law, Dirty Biker Design, LLC d/b/a Party With a Pole shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website, rental equipment, or services.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot legally be excluded under applicable law.
19. Indemnification
You agree to defend, indemnify, and hold harmless Dirty Biker Design, LLC d/b/a Party With a Pole, its owners, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable attorney’s fees arising from your violation of these Terms or your use of our services, except to the extent caused by our gross negligence or willful misconduct.
Your use of this website is also governed by our Privacy Policy.
Information collected through reservations and purchases will be handled in accordance with that policy.
By providing your email address or telephone number, you consent to receive communications relating to your reservation, including confirmations, reminders, service updates, and customer support communications.
You may also receive marketing communications if you separately opt in. You can unsubscribe from marketing emails at any time.
Party With a Pole shall not be liable for delays or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, government actions, labor disputes, transportation disruptions, power outages, or other unforeseen events.
23. Governing Law
These Terms shall be governed by the laws of the State of Iowa without regard to conflict of law principles.
Any legal action relating to these Terms shall be brought in a court of competent jurisdiction located in the State of Iowa.
We may update these Terms from time to time.
Revised Terms become effective when posted on our website.
Continued use of our website or services after revisions are posted constitutes acceptance of the updated Terms.
